Thomas Kennedy, escritor argentino-estadounidense y activista por los derechos de los inmigrantes, demandó al gobierno federal para exigir que borre los datos que, según él, un agente de Customs and Border Protection copió de su teléfono en el aeropuerto de Miami. Los tribunales reconocen desde hace décadas una «excepción fronteriza» a la Cuarta Enmienda que permite registrar dispositivos electrónicos sin orden judicial. CBP sostiene que en el año fiscal 2025 solo revisó 55.318 de los más de 419 millones de viajeros.
