OpenAI settles claims of discrimination against US workers for $3.2M
The Justice Department announced that OpenAI and its subsidiary Statsig will pay $3.2 million to resolve allegations that they favored foreign workers on temporary visas over U.S. citizens in hiring. The investigation found the companies recruited and hired foreign workers without advertising positions on their external job site, and used unusual tactics like late-night ads and paper-only applications to discourage U.S. applicants. The settlement includes a $1.2 million civil penalty and a $2 million back-pay fund, plus required changes to hiring practices and training on immigration law.
While we disagree with the DOJ's findings, we reached this agreement to resolve the matter and move forward with our PERM program, which is critical for employees and candidates requiring immigration support.

It's important to remember this was only over 10 positions so while the overall amount seems low, the per-position fine was pretty high.
